By using the Website or purchasing from us online, you agree to these Terms. If you do not agree, do not use the Website.

- Eligibility, Alcohol & Capacity
To use the online store and place orders you must:
• Be 18 years or older if your order includes alcohol.
• Be legally capable of entering into a binding contract.
• Provide accurate and current information.
We reserve the right to:
• Request proof of age and identity.
• Cancel any order we reasonably believe breaches liquor laws or these Terms.
- Online Store & Pricing
• All prices are in South African Rand (ZAR) and include VAT, unless stated otherwise.
• We reserve the right to change prices, offers, product availability and product descriptions without notice.
• A placed order is an offer to purchase. No contract exists until payment is received and we accept your order by sending a dispatch confirmation.
We may, at our discretion, limit or cancel quantities purchased per person, per household or per order.
- Payments
We accept payments via:
• Secure payment gateways (e.g. credit/debit card, instant EFT), and/or
• Manual EFT where offered (orders only processed once funds reflect).
If payment is not received within the time specified at checkout (for EFT), we may cancel the order.
We do not store your full card details. Card payments are processed by third-party payment processors under their own security and privacy policies.
- Orders, Delivery & Risk
• Orders are only processed after successful payment.
• Delivery is handled in terms of our Shipping & Delivery Policy above.
• Risk in the goods passes to you upon delivery to the address you provided and confirmation by the courier of delivery.
If we are unable to fulfil all or part of your order (e.g. stock shortage, quality issues), we may:
• Offer a substitute; or
• Cancel the unavailable portion and refund you for that portion.
- Returns & Refunds
Returns and refunds are governed by our Returns & Refunds Policy above, which forms part of these Terms.
Because we sell alcohol and perishable products, please note the strict limitations on “change of mind” returns.
- Karusa Rewards, Membership & Affiliates
We may offer: - Karusa Rewards Programme
• Earn points or credits for qualifying purchases and actions (e.g. placing orders, certain promotions).
• Rewards may be redeemed for discounts or benefits at our discretion.
• Points/credits are not cash, may expire, and are subject to programme-specific rules published on the Website.
• We may adjust, suspend or terminate the programme at any time. - Membership (e.g. Wine Club / Free Shipping Membership)
• Eligible members may receive benefits such as free shipping above a threshold, early access to releases, or special pricing.
• Membership benefits, fees (if any), conditions and cancellation rules will be set out in the specific Membership Terms on the Website.
• We may change or withdraw membership benefits with reasonable notice. - Affiliate Programme (YITH Affiliates)
• Approved affiliates may earn commission on referred sales.
• Affiliates must comply with the separate Affiliate Terms and all applicable advertising and liquor laws.
• Affiliate commissions do not change the retail price paid by customers.
We may, at our discretion, suspend or terminate any account abusing rewards, membership or affiliate benefits (e.g. fraud, fake referrals, self-referrals in breach of rules).
- Reviews, “Review for Discount” & User Content
We encourage honest reviews of our products and services.
• “Review for discount” promotions (e.g. YITH Review for Discount) may offer a coupon or reward for leaving a genuine, good-faith review after a verified purchase.
• Coupons/rewards are granted for the act of reviewing, not for leaving only positive reviews.
• We reserve the right to:
– Moderate, edit or remove any review or comment that is defamatory, abusive, spammy, misleading or not related to the product/experience.
– Reject reviews which we reasonably believe to be fake or incentivised in a misleading way.
By posting content (reviews, comments, photos) you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business (e.g. on the Website, newsletters, social media), subject to applicable law.
You remain responsible for ensuring your content does not infringe third-party rights, breach confidentiality, or violate any laws.

As far as the law allows:

Our total liability for any claim relating to an order will not exceed the total amount paid by you for that order.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so (for example, death or personal injury caused by our gross negligence, or your rights under the CPA where applicable).

- Choice of Law & Disputes
These Terms are governed by the laws of the Republic of South Africa.
If we cannot resolve a dispute informally, either party may refer the matter to a competent South African court. You consent to the jurisdiction of the High Court of South Africa (Western Cape Division).

We may change these Terms from time to time. Updated versions will be posted on the Website and will apply from the date of posting.
